Assignment of Program Codes "H6" and "H7" to track Fiscal Year (FY) 2012 Funds Provided for the Section 1207(n) Transitional Authorities for East Africa and Yemen

Program Codes "H6" and "H7" are assigned to track funds provided for Transitional Authorities under the National Defense Authorization Act (NDAA) for FY12 (P.L. 112-81), Section 1207(n) and administered by the Defense Security Cooperation Agency (DSCA) as Building Partner Capacity programs. FY12 funds provided for Section 1207(n) will expire for new obligations no later than September 30, 2012, and in compliance with the terms in the NDAA and the FY12 DoD Appropriations Act (P.L. 112-74). Funds associated with H6 and H7 Letter of Offer and Acceptance (LOA) documents should be fully expended, reconciled, and closed on or before July 31, 2017.

Management and execution of Section 1207(n) programs will comply with guidance provided in the Security Assistance Management Manual (SAMM), Chapter 15, Building Partner Capacity (BPC) Programs (found on the DSCA web page). The Transitional Authorities for East Africa and Yemen are funded by the FY12 Defense-Wide Operation and Maintenance (DW O&M) Appropriation. The Secretary of Defense, with the concurrence of the Secretary of State, has authority to provide equipment, supplies, training, and minor construction to enhance the capacity for conducting counterterrorism operations of the national military forces, security agencies serving a similar defense function, and border security forces of Djibouti, Ethiopia, and Kenya (Section 1207(n)(1)(A)); the national military forces participating in the African Union Mission in Somalia (Section 1207(n)(1)(B)); and the Yemen Ministry of Interior Counter Terrorism Forces (Section 1207(n)(1)(C)). Combatant Commands and Implementing Agencies develop and execute program requirements using procedures applicable to the Section 1206 Program. See Section C15.1.4.4.

Instructions for preparation of H6 and H7 LOA documents are found in the SAMM, Table C15.T5, Instructions for Preparing Pseudo LOAs. Implementing Agencies will ensure that a single Benefitting Country is selected for each line on the H6 LOA, to include any Benefitting Country with national military forces participating in the African Union Mission in Somalia (see C15.T5, line 10).
