SUBJECT :

Clarification of DSCA Policy 16-27 Regarding Temporary NATO+ Status for Jordan with Regard to Certain Requirements of the Arms Export Control Act of 1976 (AECA), DSCA Policy 16-31

REFERENCE :

  1. Temporary NATO+ Status for Jordan with Regard to Certain Requirements of the AECA, DSCA Policy 16-27

Referenced memo incorrectly cites the United States-Jordan Defense Cooperation Act of 2015 as Public Law 114-124. The correct number is PL 114-123.

The memo correctly states that PL 114-123 authorizes waiver of quality assurance, inspection, contract administration, audit and catalog service costs under Section 21(h) for Jordan. This authority expires February 18, 2019. To clarify, however, the waiver of charges for Contract Administrative Services (CAS) is not automatic. PL 114-123 makes Jordan eligible for waiver of CAS elements under the terms available to the NATO+five countries, which include an agreement to provide such services on a reciprocal basis, without charge, to the United States Government. Such agreements with Jordan have not yet been concluded. If and when they are, a separate policy memo will be issued and SAMM C9.T5 will be updated.

For any questions regarding this policy, please contact Mike Slack DSCA/STR/SPI, at (703) 697-9058 or micheal.d.slack.civ@mail.mil.
