Assignment of Program Codes for Building Partner Capacity (BPC) Programs Authorized in Fiscal Year (FY) 2013, DSCA Policy 13-02, [SAMM E-Change 216]

DSCA receives appropriated funds to implement BPC programs authorized by law in the current fiscal year. In order to provide Implementing Agencies (IAs) with the greatest degree of flexibility to manage the development of associated Letters of Offer and Acceptance (LOAs), program codes for BPC authorities available in FY13 are assigned effective immediately and the Security Assistance Management Manual (SAMM) is changed in accordance with the attachment.

IAs may begin development of BPC LOAs in the Defense Security Assistance Management System (DSAMS) upon receiving requirements and case designations from the DSCA Program Manager. Development and management of BPC LOAs will comply with guidance provided in the SAMM, Chapter 15. Standard notes applicable to BPC programs are found in the SAMM, Appendix 6, LOA Notes Listing.

Program funds are generally available for obligation pursuant to their program authority and until the end of their period of appropriation; however, funds provided under a Continuing Resolution (CR) authority will expire for new obligations in compliance with the terms of that authority. For example, funds provided under the FY13 CR, P.L. 112-175, expire for new obligation on March 27, 2013. As new appropriation authorities become available, Table C15.T2 will be updated and the LOA Fund Source notes will cite the new appropriation. IAs will specify the full period of performance for services on LOA documents, consistent with period of performance guidance provided in C15.3.4.4. Program funding will be fully expended, and cases will be reconciled and closed on or before July 31 of the Funds Cancellation FY.

  2. Change C15.1.4.9. to read as follows:

    C15.1.4.9. Counterterrorism Assistance for East Africa and Yemen. Counterterrorism Assistance for East Africa and Yemen is authorized under Section 1207(n) the FY12 NDAA and under Section 1203 of the FY13 NDAA. These authorities are funded by Defense-Wide Operation and Maintenance (DW O&M) Appropriations. The Secretary of Defense, with the concurrence of the Secretary of State, may provide equipment, supplies, training, and (under Section 1203) minor military construction. The purpose of these programs is to enhance the ability of the Yemen Ministry of Interior Counterterrorism Forces and to enhance the capacity of the national military forces, security agencies, counterterrorism forces, and border security forces of Djibouti, Ethiopia, Kenya, and national military forces participating in the African Union Mission in Somalia to conduct counterterrorism operations against al-Qaeda, al-Qaeda affiliates, and al-Shabaab. Funds obligated for Section 1207(n) programs before the end of FY12 are available until completion of the projects. See Section C15.3.4.5. Amounts available for Section 1203 in a fiscal year may be used for programs that begin in such fiscal year but end in the subsequent fiscal year. See Section C15.3.4.3. CCMDs and IAs develop and execute Section 1207(n) and Section 1203 program requirements using procedures applicable to the Section 1206 Program.
