DSCA Policy Memo 24-30, DoD Sales to U.S. Companies for Incorporation into End Items has been posted.

This memorandum updates general policy and process guidance on Section 30 sales agreements, including moving this guidance from DSCA 24-04 Attachment B to SAMM Appendix 8. Arms Export Control Act (AECA), Section 30 (22 U.S.C. 2770) authorizes the USG to sell defense articles and defense services to U.S. companies in support of direct commercial sales pursuant to an approved export license. In accordance with 10 U.S.C. 382(b), the DSCA Director has the authority to execute, administer, and delegate approval authority of all security cooperation programs and activities of the Department of Defense involving the provision of defense articles, military training, and other defense-related services by grant, loan, cash sale, or lease.

DSCA is excited to announce the release of "Chapter 11 - Security Assistance and Security Cooperation Programs", "Chapter 15 - Building Partner Capacity Case Development, Implementation, and Execution Process," and "Appendix 8 - Security Assistance and Security Cooperation Programs." This multi-year effort to further integrate Building Partner Capacity guidance into the SAMM. We would like to thank the members of the security cooperation (SC) and security assistance (SA) community that has helped us reach this major milestone.

Details:

• Chapter 11 contains an overview of SC/SA, explains the relationship between the two, and describes the various authorities.
• Chapter 15 has been updated to focus on the case process for Building Partner Capacity.
• The newly created Appendix 8 provides an initial listing of 19 SC and SA programs and is structured to be easily searched and updated. Appendix 8 will be expanded/backfilled with additional programs via future policy memos.

Important Notes:

DSCA Policy Memo 24-47, Guidance for Processing Letter of Offer and Acceptance Documents to Cease use of United States Munitions List Category XXI in the Automated Export System has been posted.

On 3 March 2023, DSCA Policy Memo 23-30 advised that the Automated Export System (AES) in the Automated Commercial Environment (ACE) will no longer allow for the improper use of the International Traffic in Arms Regulations (ITAR) United States Munitions List (USML) Ref(a) Category XXI (CAT XXI) when submitting Electronic Export Information. The Department of State's Directorate of Defense Trade Controls (DDTC) has informed the DoD that after 31 December 2024, use of CAT XXI will cause a critical error in AES.

This non-eSAMM policy memorandum implements the long-term solution to fully decouple T10 BPC funds, effective October 1, 2024, and provides interim guidance to support implementation. The policy guidance in this memorandum reflects the BPC Long Term Solution e-SAMM changes DSCA adjudicated with the BPC community during a September 25, 2024, phone conference. Pursuant to Section 21h of the Arms Export Control Act, the President may waive charges for Government Quality Assurance (GQA) services under Foreign Military Sales (FMS) cases if the foreign partner provides GQA services to the United States without charge on a reciprocal basis in accordance with an agreement. The Department of Defense of the United States of America and the Ministry of Defense of Japan concluded such an agreement on April 17, 2023. Effective immediately, the Contract Administration Services Quality Assurance and Inspection (QA&I) surcharge for all new FMS cases implemented for the Ministry of Defense of Japan on or after April 17, 2023, are to be waived.

DSCA establishes milestones and standards for the length of time Implementing Agencies (IAs) should take to prepare LOAs, Amendments, and Modifications using Foreign Military Sales (FMS) processes. DSCA and the IAs collectively analyze actual performance against established standards to inform, develop and execute changes to improve speed, flexibility, and responsiveness of FMS document preparation processes. The Government Accountability Office (GAO) noted in audit report 20-386 that, although there is a requirement for the Ias to report performance/delivery within a 30-day timeframe to DFAS, the agencies and DSCA lacked a review mechanism to ensure deliveries were reported timely and accurately. Based on the GAO audit and recommendation, DSCA/DBO/FPA is implementing a process to review the DFAS/Security Cooperation Accounting (SCA) monthly report “IA Delivery Report Card” to monitor the accuracy and timely reporting of deliveries.

The Security Assistance and International Programs Deposit Account was established in 1978 to support the North Atlantic Treaty Organization (NATO) E-3A Program deposit account. Currently, the SAIP Deposit Account is not part of the SAA Financial Statements and therefore it does not comply with the requirement for all SAA activities to be reported in the SAA Financial Statements. Effective Fiscal Year 2021, DSCA will include SAIP Deposit Account under DSCA purview of the SAA Financial Statements to report all SAA activities.

DSCA Policy Memo 20-47, Department of Defense Appropriated Building Partner Capacity (BPC) Accounting Interim Solution has been posted.

Title 10 (T10) BPC authorities leverage the existing Foreign Military Sales (FMS) process and infrastructure to procure authorized defense articles and defense services, as well as track and report BPC case execution to support Department of Defense security objectives. To utilize the FMS process, T10 BPC funds are transferred to the FMS Trust Fund under the authority of the Economy Act (31 U.S.C. § 1535). Based upon recent guidance from the Office of the Under Secretary of Defense, Comptroller (OUSD-C) and DoD Office of General Counsel (DoD OGC) Fiscal, DSCA determined that BPC case funds transferred to the FMS Trust Fund for indirect charges (i.e. FMS Administrative surcharges, Contract Administration Services (CAS) surcharges, transportation, and Packing Crating and Handling (PC&H) costs) do not conform to U.S. Government (USG) accounting and appropriation fiscal requirements. The interim solution will be implemented on October 1, 2020 (Fiscal Year 2021).

This memorandum updates chapter 6 of the SAMM to establish new requirements and procedures for the Implementing Agencies (IAs) to request an Exception to Policy (ETP) in order to facilitate more timely case development. Effective immediately, an ETP is required for all policy exceptions including, but not limited to FMS, Building Partner Capacity (BPC), training, and financial policies, except requests associated with prior year adjustment and case closure. IAs must submit ETPs at the earliest possible point in the LOA development process to avoid delays. Effective 30 June 2020, CWD will apply the new payment schedules to all new basic cases entering the writing phase. Payment schedules for Amendments and Modifications will continue to be prepared using the payment schedule contained in their respective basic case. These payment schedule revisions, along with more accurate delivery schedules and requisitioning estimates, should help reduce the over-collection of cases.

DSCA Policy Memo 20-16, Updates to Transportation Policy has been posted.

This memorandum revises the Section C.7.12. Defense Transportation System Costs policy to clarify that non-premium one-time-only transportation costs may be used below-the-line. This language does not change the requirement that any premium one-time-only transportation must be placed above-the-line on a separate line item.

This memorandum adds Section C.9.17. Foreign Military Sales (FMS) Trust Fund Transportation Cost Clearing Account. This language defines account upper and lower controls and provides for daily, monthly and annual reviews of this account.

DSCA Policy Memo 19-14, Enhanced End-Use Monitoring Procedures for Enhanced Case-Unique Articles has been posted.

This memorandum updates Enhanced End-Use Monitoring (EEUM) procedures described in Chapter 8 of the Security Assistance Management Manual (SAMM). Currently, there is no way to identify or track EEUM defense articles considered "Case-Unique." Enhanced Case-Unique articles are items not generally treated as EEUM but are designated as EEUM for specific Foreign Military Sales (FMS) exports.
