    Pursuant to Section 21h of the Arms Export Control Act, the President may waive charges for Government Quality Assurance (GQA) services under Foreign Military Sales (FMS) cases if the foreign partner provides GQA services to the United States without charge on a reciprocal basis in accordance with an agreement. The Department of Defense of the United States of America and the Ministry of Defense of Japan concluded such an agreement on April 17, 2023. Effective immediately, the Contract Administration Services Quality Assurance and Inspection (QA&I) surcharge for all new FMS cases implemented for the Ministry of Defense of Japan on or after April 17, 2023, are to be waived.

The Implementing Agencies (Ias) are not authorized to have case lines with zero-dollar value (or any other non-executable dollar value (i.e., $1, $2 etc.)) for the sole purpose of serving as a placeholder for unidentified requirements.

    This memo revises C6.7.5. Reduction of Value on Unused FMS and BPC Cases and sub-sections.

  • DSCA Policy Memo 20-72, Monthly Oversight and Review of Performance Reporting has been posted.

    The Government Accountability Office (GAO) noted in audit report 20-386 that, although there is a requirement for the Ias to report performance/delivery within a 30-day timeframe to DFAS, the agencies and DSCA lacked a review mechanism to ensure deliveries were reported timely and accurately. Based on the GAO audit and recommendation, DSCA/DBO/FPA is implementing a process to review the DFAS/Security Cooperation Accounting (SCA) monthly report “IA Delivery Report Card” to monitor the accuracy and timely reporting of deliveries.

  • DSCA Policy Memo 20-15, Program Execution Requirements under 10 USC Section 333 has been posted.

    Effective immediately, this memorandum implements the attached program execution requirements for programs pursuant to Title 10, Chapter 16, Section 333 (Section 333, Train & Equip) authority. The attached program execution requirements will be included in a future comprehensive revision to Chapters 11 and 15 of the Security Assistance Management Manual (SAMM) to reflect Fiscal Year (FY) 2017 National Defense Authorization Act consolidation of multiple authorities and its impact on execution.

  • DSCA Policy Memo 20-16, Updates to Transportation Policy has been posted.

    This memorandum revises the Section C.7.12. Defense Transportation System Costs policy to clarify that non-premium one-time-only transportation costs may be used below-the-line. This language does not change the requirement that any premium one-time-only transportation must be placed above-the-line on a separate line item.

    This memorandum adds Section C.9.17. Foreign Military Sales (FMS) Trust Fund Transportation Cost Clearing Account. This language defines account upper and lower controls and provides for daily, monthly and annual reviews of this account.

  • DSCA Policy Memo 20-03, Calendar Year (CY) 2020 Transportation Costs Look Up Table Rates has been posted.

    Memo provides the CY20 transportation costs to be applied to sensitive and hazardous end items that are shipped to Foreign Military Sales customers via the Defense Transportation System. These CY20 rates will be published as E-Change 465 to the Security Assistance Management Manual, Appendix 2, A2.2. DFAS-Indianapolis will update the Defense Integrated Financial System (DIFS) with the new rates effective 10 February 2020.

    This memo adds CY2020 Transportation Rates to A2 - Transportation Cost Look-Up Tables.

  • DSCA Policy Memo 19-32 Update to Cargo Preference Requirements has been posted.

    This memorandum updates the Cargo Preference requirements in Chapter 7 of the Security Assistance Management Manual (SAMM) to reflect the current ocean shipping environment and to ensure the maximum amount of applicable cargoes are carried by U.S. Flag vessels, while remaining responsive to foreign partners’ needs.

  • DSCA Policy Memo 19-43 Reduction to the Foreign Military Sales (FMS) Contract Administrative Services Surcharge Rate and Rate Structure has been posted.

    In accordance with the SAMM, Chapter 9, paragraph C9.16.3.3, DSCA conducted a comprehensive review of the Contract Administration Services Cost Clearing Account, including a review of the CAS surcharge rate. This review concluded that higher than expected annual sales has led to a healthy account balance sufficient enough to meet anticipated expenditures until the next review cycle in five years and supported a reduction to the CAS surcharge rate. As a result, the Office of the Under Secretary for Defense – Comptroller has approved a 0.20% reduction – from 1.20% to 1.00% -- in the CONUS FMS CAS surcharge rate, effective February 1, 2020.

  • DSCA Policy Memo 19-40 Special Bill Arrangement Notification on the Letter of Offer and Acceptance has been posted.

    Effective immediately, all Foreign Military Sales (FMS) partners with Special Bill Arrangements (SBAs) will see the following statement (see text in the policy memo) on Letters of Offer and Acceptance (LOAs) that are billed in accordance with a SBA instead of the standard DD645 issued by the Defense Finance and Accounting Service (DFAS).

  • DSCA Policy Memo 19-50 Updates to Special Defense Acquisition Fund (SDAF) Inventory Reporting has been posted.

    DoD IG recently determined that DSCA is not reporting the value of the SDAF inventory in the annual financial statement. To correct this problem, DoD IG recommended that DSCA update the SAMM to require the IAs to report the value and location of all SDAF inventory. This e-SAMM change adds three additional data points to the IA quarterly reports section in Table C11.T21 "SDAF Inventory."

    Effective immediately, a new Term of Sale “Risk Assessed Payment Schedules” is available for certain Foreign Military Sales (FMS) purchases of eligible FMS Partners. This memorandum establishes the policy to offer and implement Risk Assessed Payment Schedules (RAPS) on Letters of Offer and Acceptance (LOA) for qualified FMS Partners and updates Chapter 9 of the Security Assistance Management Manual (SAMM) accordingly.

    This memorandum provides notification of the attached updated to Chapter 9 of the SAMM pertaining to Standby Letters of Credit (SBLCs). This SAMM update clarifies and standardizes how Standby Letters of Credit (SBLCs) are approved, established, managed, and terminated by updating the SAMM Section on Standby Letters of Credit. This policy update also expands the category of banks that are eligible to issue SBLCs under DSCA’s SBLC program to include U.S.-based foreign banks that hold a Federal License from the Office of the Comptroller of the Currency (OCC) and meet the outlined eligibility criteria. This memo updates C9.9.1.5.4. Standby Letter of Credit (SBLC) (and subsections), inserts several tables, and insert a new figure Figure C9.F5. - MOU Template for SBLC into the chapter.

  • DSCA Policy Memo 19-23 Foreign Military Sales (FMS) Administrative Surcharge Rate Change Clarification has been posted.

    DSCA will assist the Implementing Agencies to identify any cases requiring surcharge rate adjustments as a result of this policy clarification as well as to communicate these changes to the international partner. Effective immediately, DSCA Policy Memo 18-48, Foreign Military Sales (FMS) Administrative Surcharge Rate Change Clarification is rescinded. Additionally, the attached implementation guidance replaces the guidance that accompanied DSCA policy memorandum 18-27.

    On February 15, 2019, Macedonia was renamed the Republic of North Macedonia, as reflected by the U.S. Board of Geographic Names precipitated by ratification of the 2018 Prespa Agreement.   • DSCA Policy Memo 18-52 Process Change to National Security Agency (NSA) Authorization-to-Sell Memoranda for Identification Friend or Foe Cryptographic Equipment and Electronic Key Loaders has been posted.

    The CJCSI 6510.06C, Communications Security Releases to Foreign Nations, and the Security Assistance Management Manual 5105.38-M, Chapter 3, Table C3.T8., requires Implementing Agencies (IAs) request an ATS from NSA for IFF Mode 5 cryptographic equipment and/or electronic key loaders offered for the first time to a foreign partner through any basic Letter of Offer and Acceptance (LOA) or Amendment to an implemented LOA. . Under the new process, a single ATS can be submitted as authorization for the transfer of unlimited quantities of IFF Mode 5 cryptographic equipment and/or electronic key loaders on multiple LOAs. This change is part of an ongoing Communications Release reform effort to streamline and align policy guidance with the Committee on National Security Systems (CNSS) release authorization process, saving time and effort for the IAs and NSA Technology Security Foreign Disclosure (TSFD) offices that process authorization requests to sell these devices.

    This policy memo updates Chapter 3 - Technology Transfer and Disclosure of the SAMM, sections C3.7.3.2.2. COMSEC/INFOSEC Release and C3.7.3.2.4. INFOSEC Validation/Authorization.

  • DSCA Policy Memo 19-03 Prior Year Adjustment Requests for Building Partner Capacity (BPC) Cases has been posted.

    In order to make the prior year adjustment request process more efficient this memorandum establishes definitive timelines for completing the review process, clarifies the required documentation that must be submitted for all requests, requires all prior year requests are completed via an LOA Amendment, and changes the approval authority for BPC LOAs from the DSCA Chief Financial Officer to the DSCA/Directorate of Business Operations (DBO) Comptroller (CMP) for all funding requests which increase the total case value (TCV) of the LOA and the DSCA/DBO Business Deputy for Country Financial Management (CFM) for all adjustment requests within the TCV of the LOA and Period of Performance extensions.

    This policy memo updates Chapter 15 by adding section C15.5.3.6. Prior Year Adjustment (PYA) Requests.

  • DSCA Policy Memo 19-06 Letter of Offer and Acceptance (LOA) Revised Pricing Guidance has been posted.

    This memo revises pricing guidance to enable time savings in the LOA document generation, review, and issuance process. This policy memo updates Section C5.4.13.2. of the SAMM.

  • DSCA Policy Memo 19-08 Cancellation of Temporary NATO+ Status for Jordan with Regard to Certain Requirements of the Arms Export Control Act of 1976 (AECA) has been posted.

    The United States-Jordan Defense Cooperation Act of 2015, Public Law (P.L.) 114-124, which became effective on February 18, 2016, required that during a three-year period beginning from the date of enactment, Jordan would be treated as if it were included with the NATO+ five countries with regard to a variety of requirements of the AECA. This authority expired February 18, 2019 and no longer applies unless renewed by the U.S. Congress.

  • DSCA Policy Memo 18-62 Electronic Transfer of Foreign Military Sales Case Data to U.S. Customs and Border Protection has been posted.

    U.S. Customs and Border Protection (CBP) and DSCA have recently automated the transfer of electronic data for exports of FMS articles. Providing this information through a system-to-system interface increases the accuracy of the data and eliminates the inefficiency of providing a physical copy of the LOA to CBP. This policy memo updates Chapter 7 of the SAMM to provide guidance on export processes now that the electronic interface with CBP is in place.

  • DSCA Policy Memo 18-35 Revision of Section 2.8 of Letter of Offer and Acceptance (LOA) Standard Terms and Conditions has been posted.

    In correspondence with Defense Procurement Acquisition Policy's (DPAP) revision of the DFARS, the DSCA 18-35 will amend Standard Terms and Conditions (STC) 2.8 by removing specific reference to the DFARS by clause and referring to the general USG offset policy that “although offset agreements, as defined in the Defense Federal Acquisition Regulation Supplement, are not within the scope of the DoD contracts entered into to fulfill the requirements of this LOA, offsets may be reimbursed through such contracts." STCs will continue to reflect the USG law and policy on offsets and direct the foreign partner to seek information from Industry.

    This memo updates C5 - FMS Case Development.

    Thois policy identifies the requirement for Security Cooperation Organizations (SCOs) and purchasers to provide copies of LORs to State Department and DSCA that indicate whether FMS Credit (Non-Repayable) will be used as a term of sale (i.e., funded with Foreign Military Financing (FMF)). The policy also requires SCOs to evaluate FMF funded LORs to ensure they align with the approved purpose and cost limitations for FMF funds as outlined in the latest Congressional Budget Justification Annex.

  • DSCA Policy Memo 12-38 Compressed, Rapid Acquisition, Fielding and Training (CRAFT) has been posted.

    Approved by the Secretary of Defense on 25 July 2011 as a Security Cooperation Reform Task Force (SCRTF) initiative in the Phase I Report, CRAFT is intended to be a formal process for handling urgent partner nation capability requirements that cannot be addressed fast enough through existing FMS procedures.

    CRAFT is not meant to be a universal remedy for capability delivery and would only be used when the Secretaries of Defense and State agree that extraordinary means are necessary and justified to fulfill urgent partner nation requirements.

    Together with the Special Defense Acquisition Fund (SDAF) and an improved Foreign Military Sales (FMS) process that is more anticipatory of partner nation capability requirements, CRAFT could help build partner nation capabilities through the accelerated delivery of urgently needed defense articles and services.

  • DSCA Policy Memo 12-42 Revised Notes for Communications Security (COMSEC) Enhanced End-Use Monitoring (EEUM) has been posted.

    This change to the SAMM deletes the EEUM note for Controlled Cryptographic Items (CCI) and revises existing COMSEC EEUM notes to distinguish separate requirements for NATO Members, Australia, and New Zealand from those for other countries and international organizations for both normal FMS LOAs and Building Partner Capacity Program (BPC) pseudo-LOAs.

    From this memo Table C5.T2. and Appendix 6 have been updated.

  • DSCA Policy Memo 12-36 Guidance Concerning Closure of Foreign Military Sales (FMS) Cases with Open Contracts has been posted.

    In Nov 2011, policy was approved to allow the closure of Building Partnership Capacity (BPC) cases with underlying open contracts that have no unliquidated obligations (ULOs) associated with the case because of the cancelling funds nature of these cases. This memorandum expands that policy to include FMS cases that are closed using the non-accelerated case closure procedures. FMS cases that are closed using accelerated case closure procedures can already be closed with open contracts with or without ULOs.

  • DSCA Policy Memo 12-35 NATO Agencies Reform has been posted.

    Effective July 1, 2012, the NATO Maintenance and Supply Organization (NAMSO), the Central European Pipeline Management Organization (CEPMO), and NATO Airlift Management Organization (NAMO) and their respective executive agencies, including the NATO Maintenance and Supply Agency (NAMSA), will be subsumed into the NATO Supply Organization (NSPO) and a new executive agency, the NATO Supply Agency (NSPA). Portions of the former charters will be retained to allow continuation of legislatively defined cost waivers as the applicable U.S. law currently identifies NAMSO and NAMSA by name.

    Implementing Agencies should be aware of the change to NSPA but should respond to Letters of Request from NSPA using the Security Cooperation Customer Codes (SCC Codes) and names currently assigned to NAMSA programs in Security Assistance Management Manual (SAMM) Table C4.T2C. DSCA will issue a policy memo to revise and reassign SCC Codes to reflect the new organization when the necessary legislative and regulatory changes have been made.

    There are no SAMM changes as a result of this memo.
