This memorandum provides guidance pertaining to the execution of funds appropriated by the FY11 Continuing Appropriations Act (CAA), Public Law (P.L.) 111-322, and the development of FY11 ASFF (G6), CRSP (E7), and Section 1206 (H2) Letters of Offer and Acceptance (LOAs). Funds appropriated by the FY11 CAA expire at midnight March 4, 2011, unless a subsequent authority extends the period of availability. Accordingly, all LOAs written using this authority must be implemented and funds must be obligated (on contract) by midnight March 4, 2011, unless a subsequent authority extends the period of availability.

The Funds Expiration, Purpose, Availability and Amount note for FY11 G6, E7 and H2 LOAs provided in the referenced memoranda is revised per the attached note and accompanying program information chart. However, instructions for use of this note for FY08, FY09, and FY10 CRSP LOAs, provided in reference B., remain unchanged.

The period of performance on an LOA or contract establishes the time during which services may be provided. The standard guidance for G6, E7 and H2 LOA periods of performance continues. The period of performance for U.S. Government sourced severable services may extend up to September 30, 2012 for FY11 ASFF (based on the two-year nature of ASFF) and for FY11 Section 1206 (based on the cross-fiscal year authority provided to the Section 1206 Program). The period of performance for contracted severable services may extend beyond September 30, 2012 for ASFF, but may not exceed 12 months. The period of performance for contracted severable services for Section 1206 may exceed 12 months but may not extend beyond September 30, 2012. For CRSP, the period of performance is not limited by CAA concerns.

Implementing Agencies are authorized to specify the required period of performance for severable services on FY11 G6, E7 and H2 LOAs, as long as the above performance period restrictions are respected and written notification to the service provider clarifies the obligation of that effort is subject to the availability of funds.

Once the CAA P.L. 111-322 is replaced with a new appropriation, instructions for preparing G6, E7 and H2 LOAs will be revised and all cases in any phase of the LOA process will need to be revised to cite the new appropriations public law. All implemented cases will need to be modified prior to case closure to cite the FY11 final appropriation.

Funds Expiration, Purpose, Availability and Amount - FY11 ASFF, CRSP and 1206 Programs

Mandatory for all FY11 ASFF, CRSP, and 1206 Program LOAs

"The funds financing this LOA are subject to all the requirements and restrictions under the heading of [insert authority] and CAA PL 111-322.

  1. These funds are provided in support of authority to [insert purpose].

  2. The funds carry the same time, purpose, and availability restrictions associated with fund source [insert fund source] or other funds that may be available for use.

  3. Failure to obligate the funds during the period of availability ending on March 4, 2011 will render them unavailable for new obligations unless a subsequent authority extends the period of availability.

  4. For ASFF and 1206: All funds must be expended on or before July 31, [insert canceling year].
    For CRSP: Once obligated, there are no time restrictions applicable to the expenditure of these funds.

  5. Total funds available for expenditure against this LOA are limited to the value of [insert LOA dollar value].

  6. Amendments or modifications of this LOA are only authorized with DSCA Operations written approval.
