Revised Guidance for Waiver of Rental Charges for Use of DoD Assets, DSCA Policy 13-58, [SAMM E-Change 238]

Section 245.3 of the Defense Federal Acquisition Regulation Supplement (DFARS) was recently revised to change the decision authority for waiver or reduction of charges for the use of U.S. Government property on Direct Commercial Sales (DCS) cases with foreign governments or international organizations. Effective October 31, 2013, requests for waiver or reduction of charges for the use of U.S. Government property on work for foreign governments or international organizations should be submitted directly to the contracting officer, who is authorized to approve the requests in consultation with the appropriate functional specialist.

The attached change to the Security Assistance Management Manual (SAMM) revises Chapter 9 to reflect this change to the DFARS and clarifies the new process for coordination of such requests. The attached revisions will be included in the on-line version of the SAMM found on the DSCA Web Page at http://www.samm.dsca.mil as SAMM E-Change 238. Revise Chapter 9.6.4., Waiver of Tooling Rental Charges for Use of DoD Assets, to read as follows:

C9.6.4. Waiver of Tooling Rental Charges for Use of DoD Assets. A contractor may use Government property on work for foreign governments and international organizations only when approved in writing by the contracting officer having cognizance of the property. Requests for waiver or reduction of charges for the use of Government property in cases of direct commercial sales to FMS eligible countries and international organizations should be submitted to the contracting officer, who is authorized to approve the requests in consultation with the appropriate functional specialist.
