Security Assistance Management Manual (SAMM), Administrative Changes, Defense Security Cooperation Agency (DSCA) Policy 19-36, [SAMM E-Change 424]

This memorandum updates the SAMM with clerical and administrative changes. This memorandum does not contain contextual policy changes. DSCA will issue contextual changes to the SAMM under a separate policy memo/SAMM E-change. These administrative changes will be included in the online version of the SAMM at http://www.samm.dsca.mil.

Security Assistance Management Manual (SAMM), E-Change 424 Administrative Changes

  1. C6.3.9. Clarify requirements relating to reporting offset requirements to DSCA by revising the fourth sentence to read:

    Current: "It is the responsibility of the IA to specify to DSCA, in the transmittal of any Congressional Notification, in the LOA and in any subsequent LOA Modification or Amendments, whether offset costs have been or will be included, and the amount, if known."

    Update to: "It is the responsibility of the IA to specify to DSCA, in the transmittal of any Congressional Notification, whether offset costs have been or will be included, and the amount if known."

    Rationale: DSCA needs to know specifics of any offset arrangement known at the time a Congressional Notification is being developed. Otherwise, there is no requirement for IAs to report information on offsets to DSCA on other than an ad hoc basis and no point of contact to which to report it is identified.

  2. C6.3.9.2. Delete the final sentence which reads:

    Current: "An offset note is included on the LOA. See Appendix 6."

    Update to: Delete

    Rationale: This sentence appears to be an artifact that should have been removed when the language of the offset note was entered into the LOA Standard Terms and Conditions in 2011.

  3. C6.3.10. Add the following as a new paragraph:

    Current: None

    Update to: "C6.3.10. End Use Certificates (EUCs). For policy regarding vendor requests for USG signature on EUCs, refer to DoDD 2040.03 End Use Certificates (EUCs). https://www.esd.whs.mil/Portals/54/Documents/DD/issuances/dodd/204003p.pdf"

    Rationale: Although DSCA plays no role with regard to EUCs and policy related to them, the FMS community frequently looks for guidance on the subject in the SAMM. This text will respond to such searches with a link to the direction provided by OUSD(A&S), which is responsible for providing guidance on the issue.
