SUBJECT :

Revision of Section C3.3.6. of the Security Assistance Management Manual (SAMM) (DSCA 13-56) [SAMM E-Change 236]

This memorandum updates of Chapter 3, Section C3.3.6., of the SAMM to delete references to Section 126.8 of the International Traffic in Arms Regulations (ITAR)[22 CFR Part 126.8]. Section 126.8 of the ITAR, which required defense contractors to seek approval or provide prior notification of certain marketing efforts has been rescinded by the Department of State's Directorate of Defense Trade Controls (75 FR 52622).

All of Section C3.3.6. and subordinate paragraphs are hereby deleted. Paragraph C3.3.1. is amended to read as follows:

C3.3.1. International Traffic in Arms Regulations (ITAR) Requirements. DoS policies and procedures for the permanent export of items on the U.S. Munitions List (USML), purchased under the FMS program, are set forth in the ITAR. Export of USML items, including certain services and technical information, requires a license unless it is done via FMS. If marketing efforts involve the disclosure of technical data or temporary export of defense articles, the contractor must obtain the appropriate export license. The Defense Technology Security Administration (DTSA) researches and validates license applications for DoD.

This change is effective immediately and will be included in the automated version of the SAMM found on the Defense Security Cooperation Agency (DSCA) Web Page as SAMM E-Change 236. If you have questions regarding this policy change or the SAMM, please contact Mr. Mike Slack, DSCA/STR-POL, at (703) 601-3842 or e-mail: michael.slack@dsca.mil. Implementing agencies should ensure dissemination to supporting activities. Updates to the SAMM are posted regularly at www.samm.dsca.mil.
