This memorandum exempts Foreign Military Sales Order (FMSO) I cases from case closure processes outlined in references (a) and (b). A FMSO I case provides for the purchase and sustainment of spare and repair parts in Department of War inventory and is not used to provide any defense articles to the FMS purchaser. According to reference (c), FMSO I cases are not required to include a note identifying an estimated date for case closure. This policy aims to articulate that these cases may remain open to continue supporting the requisition of spare and repair parts for FMS partners via an associated FMSO II case.
This policy memorandum does not preclude the Implementing Agency (IA) from closing a FMSO I case when it is no longer required to support FMSO II cases, nor does it exempt FMSO II cases from case closure requirements outlined in references (a), (b), and (c). IAs must continue to perform reconciliations of all FMSO cases as prescribed in the Security Assistance Management Manual (SAMM).
This memorandum is effective immediately. The policy in the attachment is incorporated into the DSCA SAMM at https://samm.dsca.mil.

Add SAMM Section C16.3.1.3.:
C16.3.1.3. Foreign Military Sales Order Cases. Foreign Military Sales Order (FMSO) I cases, which do not provide defense articles to the FMS purchaser, may remain open to ensure continued support of spare and repair requisitions through FMSO II LOAs. The Implementing Agencies (IA) may choose to close a FMSO I case when it is no longer required to support the requisition of spare and repair parts on FMSO II cases.
C16.3.1.3.1. FMSO I cases that remain open will continue execution phase reconciliation as outlined in Section C16.2.1. and the IA must maintain proper supporting documentation to support auditability of the case.
C16.3.1.3.2. FMSO II cases, which requisition spare and repair parts for the FMS purchaser, will be closed in accordance with Chapter 16.
