ANNEX A
STATEMENT OF ACTIVITIES AND ROLES

U.S. DOW ACTIVITIES AND ROLES:

1. The U.S. DoW will endeavor to complete the following activities under this Funding Arrangement, as applicable:
   1. Establish an account into which [Donating Partner] may elect to transfer funds to fund JUMPSTART FMS cases for the benefit of the Armed Forces of Ukraine;
   2. Consult with [Donating Partner] on Assistance strategies and when there is an opportunity for [Donating Partner] to provide funding Assistance for a specific capability or requirement of the Armed Forces of Ukraine;
   3. Consult with [Donating Partner], as appropriate, regarding funding issues on JUMPSTART cases for Assistance;
   4. Upon direction from [Donating Partner] to fund a JUMPSTART FMS case with the Armed Forces of Ukraine, transfer [Donating Partner’s] specified amount of funds to the designated U.S. DoW controlled trust fund account for the Government of Ukraine’s FMS activities.
   5. Execute and manage the JUMPSTART FMS cases funded under this Arrangement in accordance with U.S. law and U.S. DoW policy;
   6. Furnish Assistance either from U.S. DoW stocks and resources or via procurement in accordance with U.S. DoW acquisition regulations and procedures, employing the same contract clauses, contract administration, and quality and audit inspection procedures as would be used when procuring defense articles or defense services for the use of U.S. Armed Forces;
   7. Negotiate and execute any required modifications or amendments to U.S. FMS contracts;
   8. Designate an individual or individuals with the financial and/or technical expertise to advise [Donating Partner] on all technical and/or financial matters related to this Funding Arrangement, and to address and resolve related issues that might occur; and
   9. Carry out project management activities, including, but not limited to, the following:
      1. submission of quarterly progress reports, such as the Department of Defense Form 645 (DD Form 645), to [Donating Partner] for capabilities provided by this Funding Arrangement; and
      2. informing [Donating Partner] when delivery of the Assistance has been completed.
2. The U.S. DoW intends to, with respect to the Government of Ukraine:
   1. complete all formal agreements or arrangements with the Government of Ukraine in accordance with U.S. law and policy;
   2. facilitate the transfer of Assistance without requiring [Donating Partner] to accept title or possession of related defense articles or defense services;

[DONATING PARTNER] ACTIVITIES AND ROLES:

[Donating Partner] intends to complete the following activities under this Funding Arrangement, as applicable, which may include other activities as needed:

1. Provide funds to be held and managed by the U.S. DoW or U.S. Treasury Department in consultation with the U.S. DoW, in the manner specified by U.S. DoW and in consultation with [Donating Partner], including provisions for advance payments as is customary with the U.S. DoW; and
2. Assign [a/an] [Donating Partner] official occupying a position no lower than Director General to complete each “Direction to U.S. DoW and Funding Amount” substantially in the form and content contained as the template in Annex B.
