"Title to equipment provided on this Building Partner Capacity (BPC) Letter of Offer and Acceptance (LOA) must remain with the DoD, though temporary custody is granted to the Benefitting Partner. A Benefitting Partner representative will acknowledge in writing that the equipment received is being loaned on a non-reimbursable basis subject to the terms of the Foreign Assistance Act (FAA) Section 505 Agreement (22 U.S.C. 2314), unilateral Diplomatic Note, or other applicable agreement regarding the furnishing of defense articles and services to the Benefitting Partner."
