Delegated Authority to Receive State Department Funds under Sections 632(b) and 551 of the Foreign Assistance Act, DSCA Policy 15-18

This memorandum summarizes and reiterates the security assistance authorities delegated by the Secretary of Defense to the Director, DSCA through DoDD 5105.65. These authorities are delegated to the Secretary of Defense from the President through EOs 13637 and 12163, and the mission of DSCA, as provided in DoDD 5105.65.

DSCA, under the authority, direction, and control of the Under Secretary of Defense for Policy (USD(P)), directs, administers, and provides DoD-wide guidance to the DoD Components and DoD representatives to U.S. missions abroad for the execution of DoD security assistance and security cooperation programs over which DSCA has responsibility, in accordance with Chapter 32 (FAA) and Chapter 39 of Title 22 of the U.S. Code (Reference (a)), DoDD 5132.03 (Reference (e)), DoDD 5105.65 (Reference (d)) and other laws.

As provisions of the FAA, the Director, DSCA is responsible for directing, administering, and providing DoD-wide guidance to the DoD Components and DoD representatives to U.S. missions abroad for the execution of Peacekeeping Operations funds under sections 632(b) and section 551 of the FAA. Direct DSCA oversight of FAA section 632(b) and section 551 transactions ensures adherence to the complicated fiscal law requirements, in addition to other DoD and DSCA policy objectives, that govern the use of security cooperation funds.
