The National Defense Authorization Act (NDAA) for Fiscal Year (FY) 2026 (P.L. 119-60) made two significant changes affecting the Department’s use of Cross Fiscal Year (CFY) authority to execute Title 10 Building Partnership Capacity (BPC) programs. Section 1243 of the NDAA provides CFY authority for the Ukraine Security Assistance Initiative (USAI). Section 1202 of the Act amends 10 U.S.C. Section 333 to make CFY authority available for Section 333 programs funded with appropriations that are currently available to support Section 333 vice being available only during the fiscal year in which the funds were appropriated.
