This memorandum exempts Foreign Military Sales (FMS) contingency support cases from case closure processes outlined in references (a) and (b). Contingency support cases provide defense services to a foreign partner during urgent or unforeseen circumstances. There are no requisitions or execution against the case until the contingency operation is needed. Contingency support cases that have no execution may remain open to support the FMS partner's operational needs.

A new Letter of Offer and Acceptance (LOA) note has been created to identify contingency support cases and will be used by DSCA to remove the case from the case closure goals and objectives outlined in reference (c). Within 90 days of the date of this memorandum, Implementing Agencies (IAs) must complete a modification to any implemented contingency support case to add the new case note.

In accordance with reference (a), IAs may choose to close out cases that are no longer needed or use the concurrent modification process to establish a new case to support auditability in the general ledger and proper accounting and case logistics systems. Cases implemented FY2017 and prior with requisitions and execution may request an exemption from closure when they meet the criteria established in reference (a).

This memorandum is effective immediately. The policy in the attachment is incorporated into the DSCA Security Assistance Management Manual (SAMM) at https://samm.dsca.mil.

  1. Add SAMM Section C16.3.21. and renumber remaining section to C16.3.22.:

    C16.3.21. Case Closure Exemption for Contingency Support Cases. A contingency support case provides defense articles or services to a foreign partner during emergencies or unforeseen events. These cases are established as a "place holder" with no requisitions or execution occurring until the FMS partner requires the article or service. Therefore, contingency support cases may remain open to provide continued support to the partner until the article or services have been provided. Once requisitions and/or execution have occurred, for cases implemented FY2017 and prior, the contingency case must be closed in accordance with Chapter 16.
